This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Kewl AI, Inc. ("Kewl AI," "hii5," "we," or "us"). This EULA governs your use of the hii5 mobile application (the "App"), including any updates, features, or enhancements provided by us.

By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.

1. LICENSE GRANT
   Subject to your compliance with this EULA, Kewl AI grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial purposes.

2. RESTRICTIONS
   You agree not to:

• Use the App in violation of any applicable laws or regulations.

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.

• Modify, adapt, or create derivative works based on the App.

• Remove, alter, or obscure any proprietary notices (including copyright or trademark notices).

• Share, rent, lease, sublicense, distribute, or otherwise transfer rights to the App to any third party.

• Use the App in any manner that infringes intellectual property rights or other proprietary rights of Kewl AI or third parties.

3. OWNERSHIP
   The App, including all intellectual property rights, is owned by and remains the exclusive property of Kewl AI and its licensors. Nothing in this EULA transfers ownership or grants any rights beyond the license described herein.

4. USER CONTENT
   You may submit or generate User Content through the App, including messages, photos, videos, and AI-generated responses. You retain ownership of your User Content; however, by submitting User Content, you grant Kewl AI a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to store, use, modify, reproduce, display, and distribute such User Content consistent with our Terms of Service and Privacy Policy.

5. PRIVACY
   Your privacy is important to us. Please review our Privacy Policy, incorporated by reference, to understand how we collect, use, and disclose information.

6. TERMINATION
   This EULA is effective until terminated by you or Kewl AI. We may terminate your access to the App at any time if you breach this EULA or our Terms of Service. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.

7. DISCLAIMER OF WARRANTIES
   THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. KEWL AI DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. KEWL AI DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

8. LIMITATION OF LIABILITY
   TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEWL AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. INDEMNIFICATION
   You agree to indemnify, defend, and hold harmless Kewl AI, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the App, violation of this EULA, or infringement of any third-party rights.

10. MODIFICATIONS
    Kewl AI reserves the right to modify this EULA at any time. Any changes will be effective immediately upon posting. Your continued use of the App after changes indicates your acceptance of the revised EULA.

11. GOVERNING LAW
    This EULA shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

12. ENTIRE AGREEMENT
    This EULA, along with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Kewl AI regarding your use of the App and supersedes all prior agreements and understandings.
